HLS MS No. 59 |
England. Statutes, Magna Carta to 12 Edw. 2 |
ca. 1318 (with later additions) |
<Preliminary introductions> The HOLLIS cataloguing may be found here. The following items are worth repeating: “Description : 155 leaves : vellum ; 10 cm. “Summary : Contains a partial calendar, May-Dec. (ff. 1r-4v); an abridged Brut Chronicle, in French, (ff. 5r-10r); Confirmatio Chartum, in French, (ff. 10r-13r); Magna Carta (ff. 14r-20v); Charta Forestae (ff. 20v-23v, incomplete); Statuta Angliae (ff. 24r-154v., imperfect at beginning and end); on folio 124v is added a hymn to the Virgin; on folio 125v is added a precept to John Moygne (justice of the peace for Lincolnshire, 1486-1502). “Notes : Written by an English scribe, long lines, roman letters, 23 to a full page. “Illuminated initials.” The cataloguing in Baker’s English Legal Manuscripts, 1, no. 82 reads as follows: “STATUTA VETERA; TRACTS “MS. 59. “C.xiv, 155 ff. Includes: a partial calendar; Distinctiones sokagii (‘Sokage poet estre destincte ... ’); Expositiones vocabulorum (‘Explicit interpretatio sok et sak’); De antiquo dominico corone; Ordre de exceptioner; an abridged Brut chronicle (in French). On fo. 124v is added a hymn to the Virgin; and on fo. 125 v a precept to John Moygne [JP Lincs. 1486-1502]. “Thomas Rodd catalogue of MSS. (1847), p. 13; bought from Rodd in 1847 by Sir Thomas Phillipps (MS. 12241); his sale, S. 11 June 1896, no. 284, to Ellis for George Dunn; his sale, S. 11 Feb. 1913, no. 24; bought privately by HLS. “Census, I, 1034, no. 59; Phillipps Studies, IV, 180.” The manuscript measures approximately 100 X 73 mm. The modern board binding with cream-colored leather covering the spine is in good condition. The blank modern endpapers at the front and back were probably added when the manuscript was bound. The manuscript has 28 quires of varying lengths: eight ten-page quires, three quaternions, two ternions, five duernions, and ten bifolia, all excluding the initial and final modern endpapers. There are no signatures or carryovers, but the quire breaks are indicated by narrow strips of paper [DC note: Confirmed this by the strings in the middle of each quire. Be sure the paper strips are really part of the MS and not added by the photographer]. This gives us the following collation [DC note: Some of these will have to be changed when the images are fixed. Note also that f. 13v is near the end of the image stack in Mirador for some reason]: i (unfoliated), 14 (f. 1–4), 210 (f. 5–14), 3–44 (f. 15–22), 52 (f. 23–24), 6–78 (f. 25–40), 82 (f. 41–42), 910 (f. 43–52), 102 (f. 53–54), 1110 (f. 55–64), 122 (f. 65–66), 1310 (f. 67–76), 144 (f. 77–80), 156 (f. 81–86), 164 (f. 87–90), 176 (f. 91–95), 182 (f. 96–97), 19–2010 (f. 98–117), 212 (f. 118–119), 228 (f. 120–127), 23–252 (f. 128–133), 26–2710 (f. 134–153), 282 (f. 154–155), ii (unfoliated). |

Note: The calendar begins in May and runs through December. The first page is stained and faded, as if it once stood at the head of an unbound quire. It is done entirely in pen-work, without color. We have not analyzed the saints for regional variation.

The first page that we have describes the king of Winchester as having Gloucester, Winchester, and Warwick; the king of East Anglia, Cambridge, Norfolk, Suffolk, and Essex, and the king of Northumberland, all the land beyond the Humber.

Note: Does not seem to be in Baker, Cambridge Legal Manuscripts. The text is in French, and is not just a translation of the Latin text given in S.R. How close it comes to a paraphrase of the S.R. text requires more attention than we have been able to give it. Note: (1) Decorated initial ‘S’, unfinished. (2) This is a French version of the text that appears in HLS MS 58 in Latin. For this text, see Baker, Cambridge Legal Manuscripts 73, with reference to a number of manuscripts including this one. His folio reference is from the upper right-hand corner, which is one less than our digital foliation

258 | 125v | Hymn invoking the Blessed Virgin, alliterating on ‘p’. (Not in S.R.)
Note: Written in a more informal hand and hard to read on the image. It is very close to, without being quite the same as, the hymn on the Seven Joys of the Blessed Virgin in Analecta Hymnica Medii Aevi 15 (1893) 93 (no. 64). (Our thanks to Jan Ziolkowski for the reference.) Incipit: ‘Plaude potentissima parens plasmatoris / Persona purissima puella pudoris’. Explicit: ‘Provide ?psalterie protege presentes / ?Preganda preteritos pestimo pacientes / Ave etc Concede etc’.
259 | 126r | ||||
Note: The note at the end of verses in a later hand needs more time than we have been able to give it. It offers statistics, but also seems to refer to beheading, and to the Percy family.

270 | 131v | Mandate to a JP enforcing the Statute of labourers. (Not in S.R.)
Note: The mandate refers to ‘E. nuper rex’ and probably dates from the time of Richard II.

Heading: Explicit de Consuetudine foreste Inc’ De Antiquo D’mco corone.
Note: (1) Visible quire break. This folio is probably tipped in. It would fit better after fol. 143. . (2) Original hand resumes. (3) The page begins with the last line of Consuetudines et assise de foresta, though it is not the last line of the text in S.R. (4) The second item is an opinion of Anger of Ripon, chief clerk of CB, c. 1290–91. See Baker, Cambridge Legal Manuscripts 49–50, citing numerous manuscripts, including this one, and noting that this copy is deficient at the end.

Note: (1) Decorated initial ‘S’, unfinished. (2) The text of the Consuetudines begins in the same way as does that in S.R., but then seems to vary. It deserves more attention than we have been able to give it.
292 | 142v | Consuetudo | |||
293 | 143r | De Foresta | |||
294 | 143v | De Foresta | |||
Note: The page ends in the middle of Consuetudines et assise de foresta. It is possible that it is continued directly on fol. 132r, though it is more likely that text is missing between the two.

Note: (1) Decorated initial ‘O’, unfinished. (2) Baker, Cambridge Legal Manuscripts 70, identifies this text not as as a French version of the common Ordo exceptionum, but rather as an extract from the Curia baronis (HLS MS 162, fol. 176r).
